The Firm regularly represents individuals, including physicians,
dentists, pharmacists and other licensed medical professionals, as
well as durable medical equipment suppliers, chiropractors, podiatrists
and alternative medicine practitioners in both criminal and quasi-criminal
proceedings in the state and federal courts, including Federal False
Claims Act prosecutions, grand jury investigations, civil RICO actions
and state forfeiture proceedings. Our attorneys are particularly
sensitive to the impact that the federal government has had in the
regulation of health-care through law enforcement techniques. Accordingly,
our Department is thoroughly familiar with the Federal Sentencing
Guidelines and, when necessary, often structures plea agreements
so as to minimize professional disciplinary and other collateral
consequences for medical professionals.
All of our Department attorneys are well-versed in law enforcement procedures
and protocol, and are experienced in specialized techniques in assisting professionals
who unfortunately have become caught up in the criminal justice system. These
include consensual surrender, search warrant issues, undercover informants and
grand jury practice and procedure, including motions to quash or limit subpoena,
when applicable.
Head Mark L. Furman is a former prosecutor with, among other offices, the New
York State Attorney General Medicaid Fraud Control Unit. Our staff also includes
several attorneys with extensive experience with other prosecutorial offices,
including a former Administrative Law Judge at the New York State Department
of Health.
