Jonathan S. Hoffman
Jonathan S. Hoffman, Esq., a Partner at Hoffman Polland & Furman
PLLC is a graduate of Tufts University and Albany Law School.
He is admitted to practice in New York, New Jersey, Connecticut,
and Washington D.C. He specializes in the field of Health Care
law and Health Care Regulatory Compliance. Mr. Hoffman counsels
Providers in compliance issues, including the analysis of state
and federal fee-splitting, anti-kickback and self-referral laws.
He has created Compliance Plans for Providers with respect to
both the Fraud and Abuse regulations and the HIPAA regulations.
Mr. Hoffman organized the firm’s Departments in Auditing
and Integrity Monitoring and Regulatory Compliance (Fraud and
Abuse Compliance). He oversees the firm’s participation
and membership in the International Association of Independent
Private Sector Inspectors General (IAIPSIG).
Mr. Hoffman has extensive experience in the corporate organization
of medical practices. He has organized Multispecialty Physician
Groups, Preferred Provider Organizations, Independent Practice
Associations, Management Service Organizations and Physician
Hospital Organizations creating Integrated Health Care Delivery
Systems. His legal experience further includes the structuring
of joint venture relationships between Physicians and Hospitals
and negotiating all facets of Health Care related business transactions,
including sophisticated financing arrangements. He has negotiated
management agreements and other transactions involving mergers
and acquisitions with publicly and privately owned Physician
Practice Management Companies. He has negotiated Managed Care
contracts including capitated and risk sharing relationships
with Health Maintenance Organizations for both Physicians and
Hospitals. Mr. Hoffman has structured partnership agreements
between individual Physicians and Hospitals (including Article
28 facilities) for the construction of Health Care related facilities.
He has developed Health Care related real estate projects such
as a Faculty Practice Building, an Ambulatory Care Pavilion,
a Magnetic Resonance Imaging Center, and an Article 28 Dialysis
Unit including the construction contracts and the equipment leased.
Mr. Hoffman represents Physicians and other Health Care Providers
before the Office of Professional Medical Conduct and the Office
of Professional Discipline. He is Special Counsel to the Bronx
County Medical Society and is referred to by the Medical Society
of the State of New York and the New York State Dental Association.
He has lectured throughout the country on the firm’s philosophy
regarding Managed Care contracting and Integrated Delivery Systems,
including presentations before the National Managed Health Care
Congress and the Northeast Regional Managed Health Care Congress.
He also lectured throughout the state and at the Greater New
York Physician’s Expo on Fraud and Abuse Compliance, HIPAA
Compliance and Asset Protection Strategies.
Mr. Hoffman’s legal experience further includes the negotiation
and documentation of real estate acquisitions and development,
commercial leases and other business transactions. He has successfully
represented clients in employment, corporate, partnership and
business litigation. Mr. Hoffman also represents several commercial
lending institutions and assists clients with non-bankable funding
for various real estate projects and business acquisitions.
